TERMS OF SERVICE

Last Updated: October 7, 2026

1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of websites, webpages, forms, questionnaires, scheduling pages, educational resources, and other online services operated by John Meneses that link to these Terms (collectively, the "Services").

The Services are operated by John Meneses ("we," "us," or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.

The Services are intended for individuals who are at least 18 years old. By using the Services or submitting information through them, you represent that you are at least 18 years of age.

These age restrictions do not prevent an adult parent or legal guardian from using the Services in connection with financial or insurance matters involving a minor for whom the adult is authorized to act.

2. About the Services

The Services are designed to provide general educational information, help individuals explore financial and insurance-related topics, facilitate conversations regarding potential insurance needs and financial goals, and provide information about an independent financial-services business opportunity.

The Services may include educational content, questionnaires, financial-needs or retirement-related intake tools, contact forms, appointment scheduling, business-opportunity information, and other resources.

Using the Services, submitting information, or scheduling a conversation does not guarantee that any particular recommendation, insurance application, business relationship, transaction, or other outcome will result.

Either party may determine that no further action or relationship is appropriate.

3. Financial Education and Professional Services

Information provided through the Services is intended for general educational and informational purposes.

The Services do not provide investment or securities advice, tax advice, accounting advice, or legal advice. Information presented through the Services should not be interpreted as a substitute for advice from appropriately licensed or qualified professionals in those areas.

John Meneses is a licensed independent insurance professional. Any insurance recommendation, if appropriate, is made separately after considering information relevant to an individual's circumstances and is subject to applicable licensing requirements, carrier requirements, product availability, underwriting, eligibility, and applicable law.

Use of the Services alone does not create an investment advisory, fiduciary, attorney-client, accountant-client, tax-advisory, or other professional relationship beyond any relationship separately established through appropriate agreements or transactions.

4. Insurance Products and Information

Insurance products are issued and administered by third-party insurance carriers.

Product availability, features, benefits, costs, underwriting requirements, eligibility standards, and other terms may vary by carrier, product, jurisdiction, and individual circumstances.

Nothing contained in the Services guarantees approval or eligibility for insurance coverage, insurability, premiums or pricing, coverage amounts or benefits, interest-crediting or accumulation results, cash values, policy performance, or any other insurance outcome.

Illustrations, examples, projections, or hypothetical scenarios provided through the Services are educational unless expressly identified otherwise and should not be interpreted as guarantees of future performance or results.

When an individual applies for or purchases an insurance product, the applicable carrier's policy contract, application, illustrations, disclosures, riders, and other governing documents control the terms of that product.

5. Retirement and Financial Information

The Services may discuss retirement planning concepts, retirement accounts, employer-sponsored plans, rollovers, insurance-based retirement strategies, indexed products, tax-related concepts, and other financial topics.

Such information is educational in nature and is not investment, securities, tax, accounting, or legal advice.

Whether any particular strategy, product, rollover, transfer, or other action is appropriate depends on an individual's circumstances and may require consultation with appropriately licensed or qualified professionals.

Nothing in the Services should be interpreted as requiring or encouraging an individual to liquidate, surrender, replace, transfer, or move an existing financial or insurance product without appropriate consideration of the individual's circumstances, costs, benefits, alternatives, and applicable requirements.

6. Business Opportunity Information

Certain portions of the Services may provide information about an independent financial-services business opportunity.

This information is provided for informational and exploratory purposes and does not constitute an offer of employment by John Meneses or Diamond Leadership Development.

Diamond Leadership Development is the agency with which John Meneses is affiliated and is not the operator of these Services.

Individuals who pursue the business opportunity may ultimately enter into a contractual relationship with Experior Financial Group, subject to Experior's applicable agreements, policies, requirements, and approval processes. Information contained on these Services does not modify, replace, or supersede those agreements, policies, compensation structures, compliance requirements, or other governing documents.

Participation may require insurance licensing, errors and omissions insurance, training, compliance requirements, onboarding documentation, fees or expenses, and satisfaction of other applicable requirements.

The opportunity may involve independent-contractor status and commission-based compensation where applicable.

No representation or guarantee is made regarding income or commissions, number of clients or transactions, production, advancement or promotion, team growth, ownership opportunities, business success, or any other financial or professional result.

Compensation is not represented as being earned merely for recruiting another individual.

Individual results vary and depend on numerous factors, including effort, skill development, licensing, activity, market conditions, individual performance, and compliance with applicable organizational and regulatory requirements.

Expressing interest in the opportunity does not guarantee acceptance, licensing, contracting, appointment, affiliation, or any particular position or level.

7. Information You Provide

You may voluntarily provide information through forms, questionnaires, financial-needs or retirement-related intake tools, appointment scheduling, business-interest forms, email, telephone, text message, or other communications.

You agree to provide information that is accurate to the best of your knowledge and not knowingly false, misleading, or unlawful.

Information you provide may be used to respond to your inquiry, understand your stated needs or interests, determine whether an appropriate next step may exist, facilitate appointments, provide requested information, and otherwise operate the Services, subject to our Privacy Policy and applicable law.

You retain ownership of personal information and materials you provide. Providing personal or financial information through the Services does not transfer ownership of that information to us.

If you voluntarily provide feedback, suggestions, or ideas specifically concerning the Services, we may use that feedback to evaluate or improve the Services without an obligation to compensate you, unless otherwise agreed in writing.

8. Privacy

Our collection, use, storage, and handling of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Please review the Privacy Policy for information regarding our privacy practices.

Submitting information through the Services is subject to the Privacy Policy.

9. Electronic Communications

When you interact with the Services, you may receive manual or automated electronic communications related to your interaction, such as responses to inquiries, appointment confirmations or reminders, requested information, or other service-related communications.

Where specific consent is required for marketing calls, text messages, emails, or other communications, that consent may be requested separately at the point where your information is collected.

Acceptance of these Terms is not intended to substitute for any separate consent required by applicable law.

You are responsible for providing accurate contact information and for updating that information when appropriate.

10. Third-Party Services and Referrals

The Services may reference, use, link to, or facilitate interactions with third parties, including insurance carriers, affiliated organizations, technology providers, financial-services organizations, and independent professionals.

We may also refer individuals to appropriately licensed or qualified third-party professionals when a need falls outside the services we provide.

Third parties are responsible for their own products, services, advice, websites, agreements, privacy practices, and conduct.

Unless expressly stated otherwise, a referral, link, introduction, or affiliation does not mean that the third party's services are provided or controlled by John Meneses.

Your interactions with third parties may be subject to separate terms, policies, contracts, disclosures, and privacy practices.

11. No Guarantees of Results

Financial, insurance, business, and professional outcomes depend on numerous circumstances outside our control.

Nothing contained in the Services constitutes a guarantee of financial results, investment results, insurance outcomes, tax outcomes, business success, income, commissions, advancement, or any other particular result.

Past results, examples, hypothetical scenarios, illustrations, educational examples, or descriptions of possible strategies should not be interpreted as promises of future performance.

12. Intellectual Property

Unless otherwise indicated, the content made available through the Services, including original text, educational materials, graphics, designs, branding, names, logos, marks, frameworks, downloads, and other original materials, is owned by or licensed to John Meneses and is protected by applicable intellectual-property laws.

Subject to these Terms, you may access and use the Services and their content for your personal, non-commercial purposes.

Without prior written permission, you may not reproduce, republish, sell, license, distribute, commercially exploit, materially adapt, or make unauthorized commercial use of protected content, branding, names, logos, or marks from the Services, except as permitted by applicable law.

All rights not expressly granted are reserved.

13. Acceptable Use

You agree not to use the Services to violate applicable law or the rights of another person; submit knowingly false, fraudulent, or misleading information; attempt unauthorized access to the Services or related systems; interfere with the operation or security of the Services; introduce malicious code or harmful technology; impersonate another person or misrepresent your identity; scrape, systematically extract, or reproduce substantial portions of the Services for unauthorized commercial purposes; misuse personal or confidential information obtained through the Services; or use protected content to create unauthorized competing commercial materials.

We may restrict or terminate access to the Services when reasonably necessary to protect the Services, our rights, other users, or third parties.

14. Accuracy of Information

We make reasonable efforts to provide useful and accurate information, but information contained in the Services may occasionally contain errors, omissions, or outdated information.

Insurance products, carrier requirements, organizational programs, laws, regulations, technologies, and other external information may change without notice.

We reserve the right to correct, update, modify, or remove information when appropriate.

15. Availability and Changes to the Services

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, replace, or discontinue any portion of the Services at any time.

We are not responsible for changes made by third parties to their products, services, programs, requirements, websites, or other information outside our control.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

Except as expressly stated in these Terms or required by law, we make no warranties, express or implied, regarding the operation, availability, accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement of the Services.

Nothing in this section is intended to disclaim any warranty, right, or protection that cannot lawfully be waived.

17. Limitation of Liability

To the fullest extent permitted by applicable law, John Meneses will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of, or inability to use, the Services.

Any additional limitation of liability, liability cap, exclusions, exceptions, and treatment of claims that cannot legally be limited should be finalized following legal review.

Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law.

18. Indemnification

To the extent permitted by applicable law, users may be responsible for claims, damages, losses, or expenses arising from their unlawful misuse of the Services, violation of these Terms, or infringement of the rights of another person.

The scope, defense obligations, procedures, and other legal mechanics of this provision should be finalized following legal review.

19. Dispute Resolution

Before initiating formal legal proceedings, the parties should make a reasonable good-faith effort to resolve disputes arising from these Terms or the Services informally.

The final dispute-resolution mechanism, including whether disputes will be resolved through binding arbitration or court proceedings and any applicable procedures, waivers, limitations, exceptions, or venue requirements, should be finalized following legal review.

These Terms are intended to be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

The appropriate venue and jurisdiction for disputes should be finalized following legal review.

20. California Users

Nothing in these Terms limits any non-waivable rights or protections available to California consumers under applicable law.

Any California-specific notices or consumer disclosures required for these Services should be maintained as required by applicable law.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Services, our business practices, legal or regulatory requirements, or other relevant circumstances.

When these Terms are updated, the "Last Updated" date at the top of this page will be revised.

Unless otherwise stated or required by applicable law, revised Terms become effective when posted.

Where additional notice or consent is legally required for a material change, we will provide such notice or obtain such consent as required.

22. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular Service, constitute the agreement concerning use of the Services.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Failure to enforce a provision of these Terms does not waive the right to enforce it later.

Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency relationship between a user and John Meneses merely because the user accesses or uses the Services.

We are not responsible for delays or failures caused by circumstances reasonably beyond our control.
